Siding with US state South Dakota, the Supreme Court said the defendant, online marketplace <a href=\"https:\/\/www.cpajournal.com\/2021\/04\/26\/the-impact-of-the-u-s-supreme-courts-decision-in-south-dakota-v-wayfair\/\" target=\"_blank\" rel=\"noopener nofollow\">Wayfair, must collect sales taxes from its platform\u2019s global sellers<\/a>. The Court saw compliance costs as a temporary problem new tax technology would soon solve.<\/p>\n<p>Today, governments worldwide increasingly use sophisticated technology to tax more widely. Tax automation\u2019s big players like Thomson Reuters (<a href=\"https:\/\/tax.thomsonreuters.com\/en\" target=\"_blank\" rel=\"noopener nofollow\">TR<\/a>,) <a href=\"https:\/\/www.vertexinc.com\/\" target=\"_blank\" rel=\"noopener nofollow\">Vertex<\/a> and my employer <a href=\"https:\/\/www.avalara.com\/us\/en\/index.html\" target=\"_blank\" rel=\"noopener nofollow\">Avalara<\/a> aim to help reduce compliance risk. I think autonomous, cloud-based, always-up-to-date tax automation platforms are tax\u2019s future.<\/p>\n<h2>The Wayfair forward into tax digitalization<\/h2>\n<p>The Wayfair decision snowballed into remote tax collection and remittance liability everywhere. The <a href=\"https:\/\/www.bdo.com\/insights\/tax\/state-and-local-tax\/wayfair-its-not-just-for-sales-and-use-taxes\" target=\"_blank\" rel=\"noopener nofollow\">concept has been increasingly applied to other taxes too<\/a>.<\/p>\n<p>International tax digitalization predated Wayfair. Most European OECD countries had already implemented Digital Services Tax (DST.) <a href=\"https:\/\/www.oecd.org\/tax\/beps\/brochure-addressing-the-tax-challenges-arising-from-the-digitalisation-of-the-economy-october-2020.pdf\" target=\"_blank\" rel=\"noopener nofollow\">OECD itself came up with the framework to address digitalization\u2019s challenges<\/a>. The normally risk-averse <a href=\"https:\/\/www.washingtonpost.com\/politics\/federal-employees-working-from-home\/2021\/05\/23\/73c34304-b8db-11eb-a6b1-81296da0339b_story.html\" target=\"_blank\" rel=\"noopener nofollow\">US federal bureaucracy saw remote work jump<\/a> from 3 to 59 percent. <a href=\"https:\/\/www.mckinsey.com\/business-functions\/strategy-and-corporate-finance\/our-insights\/five-fifty-the-quickening\" target=\"_blank\" rel=\"noopener nofollow\">E-commerce saw 10 years\u2019 worth of growth in the pandemic\u2019s first 3 months<\/a> alone.<\/p>\n<h2>Government pandemic response and tax<\/h2>\n<p>The US government injected relief dollars into the economy but also saw <a href=\"http:\/\/budgetblog.nasbo.org\/budgetblogs\/blogs\/shelby-kerns1\/2020\/09\/08\/state-revenues-decline-for-first-time-since-the-gr\" target=\"_blank\" rel=\"noopener nofollow\">tax take fall 3 percent in 2020<\/a>. <a href=\"https:\/\/taxfoundation.org\/coronavirus-tax-tracker-covid19\/\" target=\"_blank\" rel=\"noopener nofollow\">Governments worldwide have passed pandemic tax relief packages<\/a>.<\/p>\n<p>This generosity must eventually end. Governments may increase indirect tax like sales tax, VAT or GST. It\u2019s an attractive policy because <a href=\"https:\/\/insight.kellogg.northwestern.edu\/article\/effects-of-sales-tax-increase-on-consumers\" target=\"_blank\" rel=\"noopener nofollow\">raising indirect taxes doesn\u2019t make people mad or change their spending<\/a>. Unlike income taxes, governments can change indirect tax rates fast to increase cash flow. In many countries, they\u2019re the <a href=\"https:\/\/www.oecd.org\/tax\/tax-policy\/revenue-statistics-highlights-brochure.pdf\" target=\"_blank\" rel=\"noopener nofollow\">biggest source of government revenue<\/a>.<\/p>\n<p>With just <a href=\"https:\/\/taxfoundation.org\/sales-tax-base-broadening\/\" target=\"_blank\" rel=\"noopener nofollow\">some of consumer purchases taxed (23 percent in the US,) there\u2019s scope for broadening the tax base<\/a>. This could include removing exemptions and lowering thresholds, legalizing controlled substances like cannabis or increasing <a href=\"https:\/\/en.wikipedia.org\/wiki\/Sin_tax\" target=\"_blank\" rel=\"noopener nofollow\">sin taxes<\/a>. As the post-pandemic economy improves, experts think <a href=\"https:\/\/www.duffandphelps.com\/insights\/webcasts-and-videos\/webcast-replay-practical-sales-use-tax-guidance-considerations\" target=\"_blank\" rel=\"noopener nofollow\">tax compliance enforcement will increase<\/a>.<\/p>\n<h2>Technology for the rise of many Big Brothers<\/h2>\n<p>What about the challenges in this direct tax future? As <a href=\"https:\/\/www.kaspersky.com\/blog\/secure-futures-magazine\/work-anywhere-tech\/40154\/\" target=\"_blank\" rel=\"noopener nofollow\">remote workers spread to distant lands<\/a>, companies face increasing risk of unintended <a href=\"https:\/\/www.bakermckenzie.com\/-\/media\/files\/insight\/publications\/2020\/04\/bloomberg-tax\/baker-mckenzie_bloomberg_transfer-pricing-considerations-for-remote-workforces_4_8_20.pdf?la=en\" target=\"_blank\" rel=\"noopener nofollow\">Permanent Establishment<\/a>, increasing their tax exposure in other countries. They\u2019ll also see <a href=\"https:\/\/www.grantthornton.com\/library\/newsletters\/tax\/2020\/HCB\/august\/new-dynamics-and-tax-risk-remote-working.aspx\" target=\"_blank\" rel=\"noopener nofollow\">increased compliance burden, from new registrations to returns<\/a>.<\/p>\n<p>Software that supports businesses with global talent management is evolving to handle complex tax situations. <a href=\"https:\/\/www.topia.com\/\" target=\"_blank\" rel=\"noopener nofollow\">Topia<\/a> has modular solutions from remote workforce planning to compliance management with insights to track emerging tax risks. <a href=\"https:\/\/www.equusoft.com\/\" target=\"_blank\" rel=\"noopener nofollow\">Equus<\/a> has similar features in its AssignmentPro platform.<\/p>\n<h2>Indirect taxes: The volatile elephant in the room<\/h2>\n<p><a href=\"https:\/\/www.ttrus.com\/\" target=\"_blank\" rel=\"noopener nofollow\">Tax research company TTR<\/a> may know best how often governments change indirect taxes. They track every change in tax rates, law and court rulings worldwide and, in 2020 alone, logged 35,000 changes in tax law. Brexit, <a href=\"https:\/\/www.globalvatcompliance.com\/globalvatnews\/india-electronic-invoicing-how-does-the-gst-e-invoice-system-work\/\" target=\"_blank\" rel=\"noopener nofollow\">India\u2019s e-invoicing<\/a> and <a href=\"https:\/\/www.reuters.com\/article\/saudi-economy-taxation-int\/saudi-arabia-could-review-vat-increase-after-pandemic-ends-minister-idUSKBN27Z1XF\" target=\"_blank\" rel=\"noopener nofollow\">Saudi Arabia\u2019s tripling VAT<\/a> typify this global tax volatility.<\/p>\n<blockquote><p>Trends like digital nomadism will only add to tax volatility, making it hard to handle without automation. But the pandemic has shown tech can short-circuit time and space to get things done fast.<\/p>\n<\/blockquote>\n<p>Sanjay Parthasarathy, Chief Product Officer at Avalara, says, \u201cBusinesses now live in a world of infinite choices, infinite channels and instant gratification. People want answers. They don\u2019t care if it\u2019s complicated. If autonomous cars drive themselves, why not autonomous tax compliance?\u201d<\/p>\n<h2>Tax automation technology<\/h2>\n<p>Tax automation firms have made it their business to tame the volatile tax elephant. First comes understanding taxation\u2019s complexity. \u201cAs professionals, we can make peace with not knowing something if we know how to find the answers,\u201d says Shon Holyfield of TTR. They offer comprehensive tax research in plain English.<\/p>\n<p>Indirect taxation puts speedbumps along the compliance journey. Some are more like spikes, like assigning the right Harmonized System (HS) number to each product. It\u2019s complex because different jurisdictions assign different numbers to the same item. Some tax automation solutions like Avalara offer <a href=\"https:\/\/www.youtube.com\/watch?v=jV3sf2JYYhk\" target=\"_blank\" rel=\"noopener nofollow\">AI-based automated classification<\/a> informed by a database of billions of products.<\/p>\n<p>Understanding millions of exemptions, preparing tax returns and handling audits seamlessly across the world needs sophisticated automation. It also needs deep integrations with other enterprise software like Point of Sale (POS) and e-commerce marketplaces. Handling big numbers of simultaneous transactions may need a cloud-native platform to be reliable. Leading tax vendors meet these challenges with varying success and coverage.<\/p>\n<p>Some tax automation providers offer special tax solutions for communication services, lodging providers and the alcohol industry. There are also tax automation service, like <a href=\"https:\/\/www.davosalestax.com\/\" target=\"_blank\" rel=\"noopener nofollow\">Davo<\/a>, for smaller retailers who don\u2019t need big integrations.<\/p>\n<h2>The future of indirect tax<\/h2>\n<p>\u201cIn Europe, governments think of the future,\u201d says Scott Peterson, Avalara\u2019s VP of Government Relations. Europe has made great strides in e-invoicing, live reporting and split payments. It means computing, filing and paying tax in real-time. Countries like India, Saudi Arabia and United Arab Emirates are following suit, but in the US, only Massachusetts is going that way.<\/p>\n<p>European governments are also simplifying taxation, like the UK\u2019s Making Tax Digital (MTD) initiative and the <a href=\"https:\/\/ec.europa.eu\/taxation_customs\/ioss_en\" target=\"_blank\" rel=\"noopener nofollow\">EU\u2019s Import One Stop Shop (IOSS)<\/a>. While it is simpler, IOSS shifts the tax collection and remittance burden from importers to remote sellers. Some are using sophisticated cross-border taxation software for this new responsibility.<\/p>\n<p>Companies like <a href=\"https:\/\/www.inposia.com\/en\/home\/\" target=\"_blank\" rel=\"noopener nofollow\">Inposia<\/a> have stepped up to offer seamless e-invoicing in 60 countries, and there\u2019s a race to prepare taxation platforms to offer e-invoicing, live reporting and split payments. Parthasarathy says platforms must move from today\u2019s task-based or document-level autonomy to spanning whole workflows.<\/p>\n<p>Peterson explains the core issue with US taxation. \u201cPoliticians hate taxes. They want the tax agencies to be friendlier, not efficient or effective.\u201d<\/p>\n<blockquote><p>The pandemic has shown governments the power of digitalization. Employees not being available to process paper documents forced them to digitalize.<\/p>\n<\/blockquote>\n<p>\u201cGovernment digitalization is for their benefit, not for businesses\u2019 filing efficiency,\u201d says Peterson.<\/p>\n<p>Senior Vice President of Compliance at Avalara, Liz Armbruester, sees global governments using more AI and analytics to detect fraud, and more audit. Are businesses ready for that? \u201cOnly about half of them,\u201d she says. \u201cThe rest are playing audit lottery.\u201d These businesses use manual processes, spreadsheets and native capabilities of their systems that often fail to keep up with tax law and regulation volatility. It means risk if audits do get more frequent.<\/p>\n<p>Armbruester continues. \u201cGovernments still think and design systems around a government-to-individual business relationship. A third-party processor can bring efficiency to both sides with batch processing.\u201d<\/p>\n<p>Until then, given the pace of change in global tax code, businesses must deal with risks at every step. Governments are lining up sophisticated technologies to plug tax loopholes rapidly.
